Title: Copyrighted material
Description: and why you shouldn't post it

wickedwitch - March 5, 2007 10:59 PM (GMT)
You may not be aware but the Owners and Admins of The Pit Lane are under contract to Invisionfree (who provide the hosting) that we will not allow any of our members to post copyrighted matter, whether that be images or text. Any infringement of this COULD get the board removed.

If you were not around at the time that HPL was deleted (and none of us really know what happened there) you will not be aware of the consternation and confusion that it caused.

I'm sure you will understand that we are all a little paranoid about the copyright thing as we have all worked very hard to get this board back up and running and we don't want it to go the same way as HPL did.

Post images by all means but if there's any with a copyright symbol on it, we'd prefer them to be just links so that there can be no legal issues for the board. Any images with a copyright symbol on them will be removed, as will any oversized images.

If you copy and paste material from another source, then PLEASE make sure that you give acknowledgement to the original source OR just post the appropriate link.

Thanks.

QUOTE
Copyright, Designs and Patents Act 1988

Chapter III, section 30. Criticism, review and news reporting.

(1) Fair dealing with a work for the purpose of criticism or review, of that or another work or of a performance of a work, does not infringe any copyright in the work provided that it is accompanied by a sufficient acknowledgement.

(2) Fair dealing with a work (other than a photograph) for the purpose of reporting current events does not infringe any copyright in the work provided that (subject to subsection (3)) it is accompanied by a sufficient acknowledgement.

(3) No acknowledgement is required in connection with the reporting of current events by means of a sound recording, film, broadcast or cable programme.

I found that on another site which is also having copyright issues.

My interpretation of (1) and (2) above is that PROVIDING you state where you took the statement from (e.g. "Found this on wickedwitch.com") that is acceptable.

With regard to (3) you can just post a link without an acknowledgement.

Photographs and images still remain a little hazy.

If in doubt, please refer to one of the Admin team before posting anything you suspect may infringe copyright issues.
